HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41221 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in not disposing of/considering the representations dated 25.8.2018, 27.8.2018 and 28.8.2018, in respect of conducting survey of lands admeasuring Ac.23.08 gts situated at Sy.No.300/1 of Mallepally Village, Kondapur Mandal Sangareddy District, as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioner submits that there is every possibility of the authorities renewing the lease in favour of the 7th respondent even in respect of the land belongs to the petitioner.

Learned Government Pleader for Mines and Mineral, would submit that the application made by the 7th respondent seeking renewal of the lease still pending consideration and orders are passed so far.

Having regard to the fact that no orders are passed so far on the application of the 7th respondent, the respondent- authorities shall take into consideration the objections raised by the petitioner vide his representation dated 28.8.2018, in respect of conducting survey of the subject land, before renewing the lease in favour of the 7th respondent. It is needless to mention that the authorities shall hear the petitioner as well the 7th respondent before renewing the lease in favour of the 7th respondent.

With the above direction, the writ petition is disposed of. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
