HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39103 of 2017 ORDER:

The petitioners substantially complain against inaction of 4th respondent in registering crime on complaints dated 10.10.2017, 16.10.2017 and 26.10.2017 as illegal and arbitrary. The Assistant Government Pleader (Home), basing on written instructions, dated 20.11.2017, submits that one of the complaints was received by registered post with acknowledgment due. The 4th respondent has made G.D. entry. When the constable of 4th respondent tried to serve notices under Section 160 of Cr.P.C, the petitioners declined to receive the same.

Be that as it may, the petitioners cannot approbate and reprobate. The 4th respondent is given liberty to serve notices under Section 160 of Cr.P.C. on the petitioners and proceed in accordance with law.

With the above observation, the writ petition is dismissed. No order as to costs.
