Heard the counsel for petitioner and the Assistant Government Pleader (Home).

The petitioner prays for the following relief :- " ..... to issue a writ more particularly one in the nature of writ of mandamus declaring the inaction on the part of the respondent authorities in not taking steps (i) for registering the FIR(s) based on the complaint dated 31.08.2017 vide CCC No. 1005 submitted to the 2nd respondent and online complaint dated 20.10.2017 vide reference No.

28718408, submitted by the petitioner, though the same attract cognizable offences, in contravention of the Law particularly as envisaged by the Hon'ble Supreme Court in Lalita Kumari case [2014 (2) SCC 1] and (ii) for taking departmental enquiry against the 5th respondent, as illegal, arbitrary, unjust and opposed to the established principles of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondent authorities to register an FIR on the online complaint dated 20.10.2017 submitted by the petitioner, appoint an investigation officer above or equal to the rank of 3rd respondent to investigate the same and to take appropriate action against the respondent Nos.

5 to 9 herein as per Law and further direct the respondent authorities to initiate departmental proceedings against the 5th respondent..."

The Assistant Government Pleader, on instructions, submits that if the copy of complaint is sent by registered post with acknowledgement due or personally tendered, 4th respondent is

are prepared to make G.D. entry and thereafter, proceed in accordance with law.

The statement is placed on record.

The writ petition is disposed of by this order. (a) The petitioner is given liberty to send copy of complaint, dated 20.10.2017 by registered post with acknowledgment due to respondents 3 and 4 by enclosing a copy of this order, within one week from today.

(b) Thereafter, respondents 3 and 4 are required to proceed in the matter in accordance with law.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
