HON'BLE SRI JUSTICE S.V.BHATT W.P.No.37153 OF 2017 ORDER:
The petitioner prays for the following relief: "...this Hon'ble Court may be pleased to issue a Writ, Order or Direction, more particularly a Writ of Mandamus declaring the action of the respondent No.3 in not conducting the investigation and not taking any further legal action against the respondent no.5 in FIRno:120/2017 which was registered for the offences which was registered for the offences U/Sec's 147, 148, 307, 324 r/w 149 IPC as illegal, arbitrary, unjust, contrary to law and violation of principles of Natural Justice and consequently direct the respondents particularly respondent no.3 to forthwith take appropriate legal action against the respondents 5th in pursuance of registration of FIRno:120/2016 in the interest of justice and pass ....."
The Assistant Government Pleader (Home), on instructions, submits that keeping in view the nature of investigation, steps required have been taken from 13.10.2017. This Court is of the view that in exercise of jurisdiction, without a case being made out, directions are not issued as a matter of course to take up investigation and complete it as per the schedule of complainant. The writ prayer is rejected. However, this Court has no reason to doubt that since FIR is already registered, the same will be taken to its logical conclusion.
The writ petition is, accordingly, dismissed. There shall no order as to costs.
