Heard the learned counsel for the petitioner and the learned Government Pleader for Home (A.P.) appearing for the respondents. 2.

When the matter is taken up, it is submitted by the learned Government Pleader for Home, on instructions, that the police seized the un-numbered trailer (bearing No.AP 03P 1614) together with other tractor and trailer bearing Nos.AP 27 AA 0806 and 0807 under cover of mahazer and registered a case in Crime No.38 of 2017, dated 18.06.2017, for the offences under Sections 447 and 379 I.P.C. and Sections 4 and 21(4) of the Mines and Minerals (Development and Regulation) Act, 1957 against the petitioner herein as A-7 and seven others and took up investigation. It is further submitted that Form-60, dated 18.09.2017, has been deposited before the III Additional Judicial Magistrate of First Class, Chittoor.

The written instructions have been placed on record by the learned Government Pleader. Learned Government Pleader also produced Form-60 before this Court. In view of the same, this Writ Petition is disposed of, keeping it open to the petitioner herein to file application before III Additional Judicial Magistrate of First Class, Chittoor for release of the seized vehicle in accordance with law.
