THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.19625 OF 2018 ORDER:

The petitioners complain against the inaction in registering the document, dated 22.11.2017, as illegal and arbitrary to Registration Act.

The prayer is that in spite of the petitioners complying with all the requirements, 3rd respondent is not completing the registration and such inaction amounts to refusing to perform the duty cast on the 3rd respondent. 3.

The counsel for the petitioners states that the difference of stamp duty payable is also paid and there ought not to be further delay in registering the document. 4.

I have perused the record. The prayer is against the inaction in completing the registration. I am satisfied in the fact situation of this case, the writ petition can be disposed of by this order.

The petitioners are given liberty to file copy of this order along with receipt showing the subsequent payment of difference of stamp duty within one week from today. The 3rd respondent on receipt of such request, completes the registration or gives a written endorsement as is warranted in the circumstance of the case within one week thereafter. 6.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
