HON'BLE SRI JUSTICE S.V. BHATT W.P. No.36589 OF 2017 ORDER:

The petitioner prays the following relief:

.... writ of Mandamus to declare the delay and inaction on the part of respondent Nos.1 to 3 police in conducting custodial investigation in FIR No.168/2016, dt.06-10-2016 on the file of the 1st respondent police station which was registered for the offence under Sec.147, 148, 395, 447, 427, 120-B, 107, 342 and 506 IPC and seize the property and file the charge sheet against the respondent Nos. 5 to 8 and others as arbitrary, illegal and consequently direct the respondent Nos. 1 to 3 to conduct fair investigation in FIR No.168/2016 on the file of 1st respondent police station by way of conducting custodial interrogation and recover the stolen property and file the charge sheet forthwith in the interest of justice." The Assistant Government Pleader places on record the letter addressed by Inspector of Police, Pulivendula to the Superintendent of Police seeking permission to file final report in the matter.

Mr.Nagendra Reddy submits that till today, the final report, if not filed before the competent court, is required to be served on the petitioner as well, but nothing has been done. The Assistant Government Pleader submits that, if final report is filed in Crime No.168 of 2016 as required by law, the petitioner is also informed the final report within four weeks from today. On receipt of final report, it is open to petitioner to work out the remedies in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.
