HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.34994 of 2017 ORDER:

The petitioner complains inaction in registering FIR on the complaint dated 13.10.2017 filed against 4th respondent before 3rd respondent as illegal, arbitrary and unconstitutional. The Assistant Government Pleader draws the attention of the court to the receipt dated 13.10.2017 issued by 3rd respondent and contends that after looking at the details set out in the complaint, the 3rd respondent has already stated that this is a civil dispute and it has to be worked out before the civil court and no cognizable offence is made out. She further submits that apart from the endorsement in receipt dated 13.10.2017, a communication will be sent to petitioner within two weeks from the date of receipt of a copy of this order.

The statement is placed on record.

After receiving the communication from respondents, the petitioner is given liberty to work out remedies in accordance with law. No order as to costs.
