HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.34995 of 2017 ORDER:

Heard Sri Amarnath counsel for petitioner and perused the affidavit.

The petitioner prays for the following relief :- " ..... declaring the action of the 3rd respondent in summoning the petitioner to police station and harassing the petitioner to settle the marital dispute between the petitioner and the 4th respondent without registering any crime and without jurisdiction and without following due process of law is illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19 and 21 of the Constitution of India and consequently direct the 3rd respondent not to summon the petitioner to the police station without there being a crime and not to interfere the marital disputes of the petitioner and the 4th respondent and direct the 3rd respondent to follow the due process of law ....." .

After going through the affidavit, this Court is of the view that with sketchy details the direction as prayed for ought not to be considered. If there is a dispute between petitioner and 4th respondent, the same has to be worked out under the Hindu Marriage Act, 1956.

The writ petition is disposed of by giving liberty to the petitioner to move appropriate application before competent court in accordance with law. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 23.10.2017 Prv
