THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.11874 of 2016 ORDER :

The petitioner herein is occupant of certain lands belonging to M/s. Koringa Company in Survey Nos.80 to 89 of Polekurru Village, Tallarevu Mandal, East Godavari District, which company had been wound-up prior to independence.

2. The petitioner claims that third-parties tried to evict persons like the petitioner and others who are cultivating the lands in the above survey numbers. It is stated that petitioner and other similarly placed persons made a representation to respondents to take action to clear encroachers and see that the land is allotted to them; that the Tahsildar, Tallarevu Mandal sent a report to the District Collector in February, 2015; and in July, 2015, the 4th respondent came to the village and conducted a spot survey and also inspected the records.

3. According to petitioner, the 4th respondent warned that no one should precipitate the matter and the whole records should be sent to 3rd respondent. The petitioner claims that he and the other similarly affected persons approached the 3rd respondent several times but there was no response from him, and that in the mean time the

respondents were preventing them from doing regular agricultural operations. He therefore, seeks a direction to respondent nos.3 and 4 to pass final orders in the matter basing upon the enquiry conducted regarding the nature of the land and rights over the land in Survey Nos.80 to 89 of Polekurru Village, Tallarevu Mandal, East Godavari District.

4. The learned Government Pleader for Assignment, appearing for respondents, states that respondents would consider the issue and pass final orders within a period of twelve (12) weeks from the date of receipt of a copy of the order.

In this view of the matter, the 3rd respondent is directed to finalize the issue relating to assignment of land to petitioner and other landless poor persons on the basis of the enquiry conducted by 4th respondent regarding the nature of the land and rights over the land in the above survey numbers; and communicate his decision thereon to petitioner and other applicants for assignment within a period of twelve (12) weeks from the date of receipt of a copy of the order.

6. Accordingly, the Writ Petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
