THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.36203 of 2017 ORDER:
Heard Mr K.Joseph, counsel for petitioner and the Assistant Government Pleader (Home) for respondents. The writ prayer is in two limbs.
(a) declaring the inaction of respondents 2 to 5 in taking action against the accused/respondent Nos.6 to 9.
(b) to direct the respondent Nos.1 to 5 to take appropriate action against the respondent Nos.6 to 9 and protect the life and liberty of the petitioner.
The first prayer refers to inaction and the 2nd prayer in not giving police protection to petitioner in spite of representation dated 11.10.2017.
The Assistant Government Pleader places on record the charge sheet dated 20.10.2017, in respect of the first limb of the writ prayer.
On the other limb of the writ prayer, she submits that if a fresh representation is made to respondent Nos.4 and 5, the same would be considered depending upon the perception and appropriate decision is taken in this behalf.
Hence, I am satisfied the writ petition can be disposed of by this order.
The petitioner is given liberty to resubmit the representation, for police protection by enclosing a copy of this order within two (02) weeks from today. The respondent Nos.4 and 5 shall consider the representation and take a decision within four (04) weeks thereafter. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
