THE HON'BLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE No.3020 OF 2018 ORDER:

This Contempt Case is filed alleging violation of the directions issued by this Court in I.A.No.1 of 2018 in W.P.No.33120 of 2018. By order, dated 18.09.2018, this Court directed the respondents to consider the case of the petitioners for promotion to the post of Motor Vehicle Inspectors, if they were otherwise eligible and qualified, in the existing vacancies.

As submitted by learned counsel for the petitioners as well as learned Government Pleader for Transport, the petitioners were reverted to the post of Senior Assistant and against the said reversion, W.P.Nos.3188, 3239 and 3300 of 2019 were filed. This Court granted interim suspension of the reversion order. 3.

According to learned Government Pleader, I.A.Nos.2 of 2019 in W.P.Nos.3188, 3239 and 3300 of 2019, respectively, were filed to vacate the said order.

Be that as it may, since the substantive position of the petitioners is yet to be determined and they are reverted to the post lower than the post in which they are working but are continuing in the present post due to interim orders of this Court, it cannot be said that there is deliberate and willful disobedience by the respondents warranting initiation of contempt proceedings. 5.

The Contempt Case is accordingly closed. However, it is open to the petitioners to work out their remedies as and when writ petitions are decided in their favour.
