Heard both sides.

The grievance of the petitioner in the present writ petition is with regard to the action of the respondents in implementing the letter dated 11.04.2016, said to have been issued by the Executive Engineer, Public Health Engineering Department, Government of Andhra Pradesh, Srikakulam, wherein the Superintending Engineer was asked to inform the following:

"....as per the agreement conditions and instructions of the Vigilance and Enforcement and the Executive Engineer (PH), Quality Control Division, Visakhapatnam an amount of Rs.1,76,47,852.17/- will be recovered in upcoming bills for the above work duly observing the directions of the Executive Engineer (PH), Quality Control Division, Visakhapatnam".

Apprehending that the respondents would act on the said letter, the present writ petition came to be filed.

Learned Special Government Pleader submits that it is only internal communication between the Executive Engineer and Superintending Engineer and there is no likelihood of respondents acting on the said letter, as no orders are passed till date. In view of the above, the present writ petition is disposed of directing the second respondent to follow due process of law and also principles of natural justice before acting on the contents of the said letter dated 11.04.2016, if the respondent-authorities intend to do so.
