KESHAV RAO W.P.No.39318 OF 2017 ORDER: (Oral) (Per Hon'ble Sri Justice SURESH KUMAR KAIT) Vide the present petition, the petitioner seeks direction thereby directing respondents No.4 and 5 to produce the alleged detenu Pokuri Keshava Chary before this Court and thereafter set him free.
2. It is not in dispute that the petitioner lodged complaint dated 10.06.2017 with Macherla Urban Police Station stating that her husband left home on 10.05.2017 for carpenter work, but did not return home. She along with her parents made enquiries about her husband with their relatives, but in vain, and hence, lodged the complaint.
3. In counter-affidavit filed by 5th respondent, at paras 4 to 6, the respondents have described the steps taken to trace the alleged detenue, and in para 6, it is stated that the missing person eloped with one Smt Pokuri Rajeswari along with her minor daughter Thanusri, answering respondent visited to Durgi, where the parents of Rajeswari are residing and enquired with her parents. On the basis of information furnished by them, the answering respondent visited Rentachintala, where Smt Rajeswari last resided along with her husband and came to know that a woman missing case
was registered under Crime No.53 of 2017 of Rentachintala Police station, on a complaint made by Mangalagiri Anjanyulu, the father of Smt Rajewari.
4. Since two crimes are registered (1) Crime No.144 of 2017 under the Head " Man Missing" and (2) Crime No.53 of 2017 under the Head "woman missing case", the respondent police certainly make their all efforts to trace the detenu/missing person.
5. Keeping in view the averments made in the counteraffidavit, we hereby close the present petition with a direction to the respondent police to communicate the petitioner, if any information received of the missing person by them. We further direct the respondent police that they continue their efforts to trace the missing person.
6. In view of the above, the Writ Petition is closed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending shall stand closed.
