SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12157 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are accused Nos.1 and 2, in Crime No.729 of 2018 on the file of the Station House Officer, Narsingi Police Station, Cyberabad District.

The offences alleged are under Sections 143, 147 and 332 R/w. Section 149 of I.P.C.

Heard learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.
The allegations in the complaint are that when the de-facto complainant, who is the Deputy Executive Engineer of H.M.D.A, along with his officials went to conduct survey in the Survey Nos.101, 102, 106, 107, 108 and 109 of Kokapet village, for proposed demarcation of 100 feet master plan grid road, as per the orders of the Commissioner, H.M.D.A., the petitioners herein, along with others, came there and beat the complainant and also kicked him with legs.

Learned Public Prosecutor, on the earlier occasion, was directed to seek instructions with regard to the injuries, if any, sustained by the defacto complainant. Learned Public Prosecutor, on instructions, reports that simple injuries were sustained by the de-facto complainant. 6.
Hence, from the above, the allegations in the complaint gain strength.

Hence, considering the above, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioners. However, the
TR,J Crl.P. No.12157/2018 petitioners/accused Nos.1 and 2 are directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application, if any, on merits, expeditiously, preferably on the same day, subject to pressure of other work.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
