THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4310 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in P.R.C.No.31 of 2015 on the file of the Judicial First Class Magistrate, Suryapet, Nalgonda District, arising out of offences under Sections 323, 506 IPC read with Section 34 IPC and Section 109 IPC and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Heard and perused the material available on record. Learned counsel for the petitioners after arguing for some time, confined his arguments with regard to dispensing with the presence of the petitioners herein.

Considering the same, the presence of the petitioners 2 to 5 herein is dispensed with except on the dates when the trial Court insists for their appearance. However, the presence of first petitioner is not dispensed with and the first petitioner shall represent on behalf of other petitioners. The petitioners shall be represented through their counsel before the Court below on all hearing dates. The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 29.03.2016 pln
