This writ petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not passing orders in the interlocutory application filed on 31.03.2016 (received by the 2nd respondent on 11.04.2016) in Revision petition pending before the 2nd respondent against the impugned order dated 11.03.2016 in Rc.No.B3/5713/2014 passed by the 3rd respondent as illegal and arbitrary. When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the present writ petition is covered by the judgment in W.P.No.12255 of 2016 dated 13.04.2016 and the same is not disputed by the learned Assistant Government Pleader for Revenue.
For the reasons alike, this writ petition is disposed of directing the 2nd respondent to dispose of the aforesaid Revision petition filed by the petitioner within three months from the date of receipt of copy of this order, after giving notice to the petitioner, in accordance with law. Till the Revision petition is disposed of by the 2nd respondent, the order dated 11.03.2016 in Rc.No.B3/5713/2014 of respondent No.3 shall stand suspended. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
A copy of the order dated 13.04.2016 in W.P.No.12255 of 2016 is to be annexed to this order.
