HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41311 of 2018 ORDER:
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not demolishing the illegal construction of a pillar, admeasuring 1.13 feet out of common passage of 3.6 feet, but also encroaching an extent of 28 inches of the petitioner's property, situated in Survey No.227/ D2 in Husnabad, Siddipet district, despite filing a complaint by the petitioner, as arbitrary, illegal and incorrect. 2.
Though various grounds are raised, the learned counsel for the petitioner submits that a representation came to be made by the petitioner to the Municipal Commissioner, Husnabad Municipal Corporation, bringing to his notice the encroachments and illegal constructions made by the unofficial respondents, without obtaining permission from the municipal authorities. Hence, pleads that the said authority may be directed to consider the representation of the petitioner.

The Standing Counsel for the respondent-Corporation would submit that if such a representation is made and if it is still pending consideration, the Municipal Commissioner, Husnabad Municipal Corporation shall deal with the same in accordance with law.

Having regard to the above, the present writ petition is disposed of with consent, directing the Municipal Commissioner,
Husnabad Municipal Corporation to deal with the representation of the petitioner in accordance with law, after hearing all concerned, including the unofficial respondents, and pass appropriate orders in accordance with law, as early as possible, preferably, within a period of six to eight weeks from the date of such representation. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
