HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.28936 of 2016 ORDER:
Vide the present petition, the petitioners seek a mandamus to declare the action of respondents in attempting to dispossess them from plot No.41 in Sy.No.60 Guttalabegumpet Village, Serilingampally Mandal, Ranga Reddy District, without following acquisition procedure prescribed under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'), as illegal and arbitrary.
Learned Counsel appearing on behalf of respondent Nos.3 and 4, on instructions, submits that the subject land was acquired for the purpose of laying road. However, the government has withdrawn the said proposal and decided not to proceed further.
Learned counsel appearing on behalf of the petitioners submits that, in view of the statement of the counsel for respondent Nos.3 and 4, the Writ Petition has become infructuous.
Recording the submission of the learned Counsel for respondent Nos.3 and 4, the Writ Petition is dismissed as infructuous.
