The case of the petitioner is that her property of 200 square yards in Plot No.54 in Survey Nos.31, 32, 34, and 47 of Allapur village, Kukatpally municipality, Balanagar mandal, was illegally sold away to the respondents 3 to 5 by some unidentified persons by impersonation and forgery. On coming to know of this fact, she filed a suit O.S.No.766 of 2015 on the file of I Additional District Judge, Ranga Reddy District, for declaration of title and cancellation of documents of respondents. The defendants (respondents 3 to 5) appeared before the trial Court, and both the parties sought to refer the matter to Lok Adalat for settlement. The Lok Adalat passed an Award on 29.10.2018 as per which the defendants voluntarily offered to cancel the documents in their possession, as they are illegal and void. The grievance of the petitioner is that though she made a representation before the 2nd respondent on 05.11.2018 requesting to cancel the registered documents executed in favour of respondents 3 to 5, the 2nd respondent has not cancelled the said documents.
Heard the learned counsel for the petitioner, and the learned Assistant Government Pleader.
Learned Assistant Government Pleader submits that there is no decree to cancel the so-called documents which are sought to be cancelled by the petitioner in the writ petition.
Learned counsel for the petitioner could not dispute the said statement. In view of the same, the representation dated 05.11.2018 filed by the petitioner seeking cancellation of documents of respondents 3 to 5 unilaterally cannot be entertained. For seeking cancellation of documents, the petitioner has to approach the appropriate Civil Court.
Accordingly, the writ petition is dismissed. No costs. Pending miscellaneous petitions, if any, shall also stand dismissed. No costs. _____________________ A. RAJASHEKER REDDY, J 23rd November, 2018 KSM
