ORAL ORDER:

Petitioners claim that Government allotted small extents of land to them for sale consideration for respective extends mentioned in the tabulated statement in paragraph 3 of the affidavit filed in support of the writ petition. Petitioners have mortgaged the property for the loan extended to them. Subsequently, the Government has waived the amount required to be paid in terms of the allotment made. However, so far, documents of the properties allotted to petitioners are not released. Alleging inaction, this writ petition is filed. 2.

It is not known why those documents are not released. However, nothing is on record to show that petitioners have requested the authorities by placing before the competent authority the relevant material in support of their claim and asking them to release the documents, but straightaway writ petition is filed placing reliance on earlier decision of this Court.

Since petitioners are not even made any endeavor to ask the competent authority to release the documents, Court is not inclined to entertain the writ petition, at this stage. Petitioners are granted liberty to file appropriate application before the second respondent society by enclosing all the relevant documents and also the decisions of this Court, relied upon by them. As and when such a request is made by petitioners, Executive Director of second respondent shall examine the matter duly taking note of the earlier decisions of this Court and if there is no impediment in releasing the documents mortgaged by petitioners, they shall be released within a period of three weeks from the date of submission of such representation.
