THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21842 OF 2016 ORDER:

Heard the learned counsel appearing for both parties and with their consent, the present Writ Petition is disposed of at the admission stage.

2 . The present writ petition came to be filed with the following prayer:

"to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents in insisting the petitioners to vacate from their respective house and site properties situated in Survey Number 757 of Nuzvid Revenue Village and Mandal of Krishna District, without following any known procedure established by law, as illegal, irregular, irrational, without jurisdiction and violative of Articles 14,21 and 300A of Constitution of India and consequently direct the respondents not to interfere in any manner with petitioners' possession and enjoyment over their said respective house and site properties and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstance of the case."

3. Though various grounds are raised in the writ petition, learned counsel for the petitioners mainly submits that they are in possession of the subject property and the respondents are trying to dispossess them without following due process of law.

4. Though the learned Standing Counsel appearing for the 2nd respondent disputed the same, but however, submits that till date no steps are taken to dispossess the petitioners and that the respondents will follow the due process of law before taking any such steps.

5. Recording the said statement made by the learned Standing

Counsel appearing for the 2nd respondent, the Writ Petition is disposed of directing the respondent authorities to follow due process of law while taking steps for dispossession of the petitioners from the subject property.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
