THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10919 OF 2017 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in Crime No.127 of 2017 of Nellore VI Town P.S., Sri Potti Sri Ramulu Nellore District, filed for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code on various grounds but the counsel for the petitioner-Accused No.6 requested to issue directions to the police concerned to follow the procedure under Section 41-A Cr.P.C.

Without touching the merits of the case and acceding to the request of the counsel for the petitioner, this Criminal Petition is disposed of directing the police concerned to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar v.
