SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12274 OF 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the Petitioner/Accused seeking to quash the proceedings in Crime No.201 of 2018, pending on the file of the Station House Officer, Keshavapatnam Police Station, Karimnagar District, registered for the offences punishable under Section 379 of I.P.C. and Section 21(1) of the Mines and Minerals (Development and Regulation) Act, 1957.

Heard learned counsel for the petitioner and learned Public Prosecutor, appearing for the respondent - State.

Learned counsel for the petitioner does not press upon the other grounds mentioned in the Petition and he only seeks for a direction to be given to the Police concerned to follow Section 41-A of Cr.P.C. 4.

Hence, considering the above, the Criminal Petition is disposed of with a direction to the Police concerned to follow Section 41-A of Cr.P.C. before affecting the arrest of the Petitioner/Accused. 5.

As a sequel, miscellaneous petitions if any, pending in this Petition shall stand closed.
