THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10898 OF 2017 ORDER:
Heard learned counsel for the petitioner/A.4 and learned Additional Public Prosecutor for the respondent State, and perused the record.
This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/A.4 in Crime No.186 of 2016 of Panyam Police Station, Kurnool District, for the offences punishable under Sections 409 and 420 IPC read with Section 34 IPC and Sections 66 and 66-B IT Act.
Learned counsel for the petitioner/A.4 would submit that earlier the petitioner was arrested and remanded to judicial custody. The entire data is available with the authorities concerned. The arrest of the petitioner is unwarranted. The allegations are totally false and ultimately prayed to allow the petition.
Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/A.4.
As per the material on record, the petitioner/A.4 worked as data entry operator in National Informatic Center. The petitioner/A.4 uploaded wrong entries in the data office in collusion with A.1 to A.3, who are the fair price shop dealers having shops within the limits of Panyam Police Station. It is brought to the notice of this Court that the earlier case where this petitioner was arrested is distinct from this case. The allegations against the petitioner are grave and seriousness of offence is high. The matter requires thorough investigation. If the
petitioner is released on bail, there is every possibility of tampering the records and winning over the witnesses. Therefore, it is not appropriate to enlarge the petitioner on bail under Section 438 Cr.P.C.
