HON'BLE DR. JUSTICE B. SIVA SANKARA RAO I.A.Nos.2 & 3 of 2018 IN/AND Crl.P.No.12370 of 2018 ORDER:

I.A.No.2 of 2018 is filed to permit S. Naresh to represent the defacto complainant as GPA holder from the GPA filed. Hence I.A.No.2 of 2018 is allowed.

The petitioner/accused No.2 and the 2nd respondent-defacto complainant are present along with their respective counsels. I.A.No.3 of 2018 is filed by them to compound the offences against the accused in C.C.No.737 of 2003 on the file of III Additional Chief Metropolitan Magistrate, Gajuwaka, which is outcome of crime No.411 of 2002 of Gajuwaka Police Station, Visakhapatnam, registered for the offences punishable under Sections 420, 120B r/w 34 IPC by stating that they settled the matter outside the Court amicably to purchase peace and terms of the compromise was also appended.

In view of the compromise between the parties, I.A.No.3 of 2018 is allowed by compounding the offences. Consequently, the Criminal Petition is allowed and the proceedings against the accused in C.C.No.737 of 2003 on the file of III Additional Chief Metropolitan Magistrate, Gajuwaka, are hereby quashed, accused is acquitted and the bail bonds of the accused, if any, stands cancelled. Pending miscellaneous petitions, if any, shall stand closed.
