THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22119 OF 2016 ORDER:

Heard the learned counsel appearing for both sides. With their consent, the present Writ Petition is disposed of at the admission stage.

2. Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondent may not be necessary.

3. The present Writ Petition is filed with the following prayer: "to issue a writ, order or direction more particularly one in the nature of a writ of Mandamus declaring the inaction of the 9th respondent herein in initiating appropriate action in pursuance to the petitioner's representation dt.3006-2016 for identifying petitioner's land to an extent of 176 Sq.Yards out of a total extent of petitioner's land to an extent of 562 Sq.Yards, in survey No.1059/E, situated at Raikal Village and Mandal, Karimnagar District, Telangana excluding the 386 Sq.yards donated by the petitioner in the year 1998, for the purpose of road upon the request of the then Sarpanch Dr.

Raja Reddy of Raikal Grampanchayat, Karimnagar District and further interfering with petitioner's peaceful possession of the said subject land as highly illegal, arbitrary, malafide, unconstitutional and consequently direct the respondents 1 and 9 herein to forthwith consider the petitioner's representation dt.30-062016 and identify the petitioner's subject land to an extent of 176 Sq.Yards out of a total extent of 562 Sq.Yards, in survey No.1059/E, situated at Raikal Village and Mandal, Karimnagar District, Telangana."

4. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent authorities to consider the representation dated 30.06.2016 made by the petitioner at the

earliest.

5. A perusal of the said representation would indicate that the petitioner seeking demarcation of land to an extent of 176 square yards out of total extent of 562 square yards in Sy.No.1059/E situated at Raikal Village and Mandal, Karimnagar District.

6. Learned Government Pleader for Panchayat Raj appearing for respondent No.9 submits that he has no objection for the same and the 9th respondent will consider the said representation if it is still pending consideration.

7. Having regard to the above, the Writ Petition is disposed of directing the 9th respondent to consider the representation dated 30.06.2016 made by the petitioner, in accordance with law, as early as possible preferably within a period of eight (08) weeks from the date of receipt of a copy of this order, after giving an opportunity of personal hearing to the petitioner and the unofficial respondent herein.
