THE HON'BLE Dr JUSTICE SHAMEEM AKTHER Criminal Revision Case No.2700 of 2017 ORDER:
This Criminal Revision Case, under Sections 397 & 401 of the Code of Criminal Procedure, 1973, is filed by the petitioner, challenging the order, dated 15.09.2017, passed in F.C.M.C.No.34 of 2013 by the Judge, Family Court - cum - Additional District Judge, Anantapuramu. 2.
Though the matter is posted on several occasions, particularly on 20.11.2017 and 03.01.2018, there was no representation for the petitioner. Today also, there is no representation for the petitioner. 3.
Learned counsel for the 2nd respondent/wife is present and would submit that the Court below had appreciated the evidence on record in proper perspective and ultimately granted monthly maintenance @ Rs.10,000/- to the 2nd respondent/wife. It is quite reasonable. There is nothing to interfere with the impugned order and ultimately prayed to dismiss the Criminal Revision Case.

As seen from the material placed on record, the petitioner herein/husband deposed before the Court below as R.W.1 and got marked Exs.B.1 to B.9 on his behalf. The 2nd respondent herein/wife deposed before the Court below as P.W.1, got examined another witness as P.W.2 and got marked Exs.A.1 to A.19 on her behalf. The Court below appreciated the evidence on record and the documents placed before it and passed a detailed order granting monthly maintenance of Rs.10,000/- to the 2nd respondent/wife from the date of maintenance application filed by her, besides imposing costs of Rs.5,000/-. The Court
below had acted upon the evidence adduced on behalf of both sides and appreciated the facts and circumstances of the case in right perspective and held that the 2nd respondent/wife is entitled to monthly maintenance of Rs.10,000/-. There is no miscarriage of justice. There are no circumstances to interfere with the impugned order. The Criminal Revision Case is devoid of merit and is liable to be dismissed. 5.
Accordingly, the Criminal Revision Case is dismissed. Miscellaneous petitions, if any, pending in this Criminal Revision Case, shall stand dismissed.
