THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.11271 OF 2017 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") seeking to quash the proceedings dated 24.08.2017 passed in Crl.P. No.80 of 2017 by the XVI Additional District and Sessions Judge, Nandigama, wherein confirmed the order dated 17.05.2017 passed in Crl.M.P. No.1239 of 2016 in M.C. No.08 of 2012 by the Additional Judicial Magistrate of First Class, Jaggaiahpet directing the petitioner to pay Rs.1,32,000/- towards maintenance to respondents 2 to 4, on various grounds.

2) Learned counsel for the petitioner requested to grant time to pay maintenance in three installments as the petitioner is suffering from financial crisis.

3) In view of the request made by the petitioner, without touching the merits of the case, the petitioner is permitted to pay the arrears of maintenance of Rs.1,32,000/- in three equal installments within three months from 1st December, failing which, the respondents are entitled to execute the order in accordance with law and the warrant issued by the Magistrate can be suspended, if the petitioner fails to pay the 1st installment in the month of December. 4) With the above observation, the Criminal Petition is disposed of.

5) Consequently, miscellaneous petitions pending, if any, shall also stand closed.
