THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.10281 of 2017 ORDER :

The petitioner is sole accused of Cr.No.84 of 2017 on the file of the Rambilli police station, Visakhapatnam district, registered for the offences punishable u/ sec.417,420 and 376IPC outcome of the report of the 2nd respondent/ defacto-complainant. The petitioner filed the quash petition to quash said crime proceedings and the 2nd respondent also present and it is their say that the petitioner/ accused and the 2nd respondent/ defacto-complainant are wife and husband and they are happily living together and there is a certificate of marriage in proof of it dt.11.10.2017 at Sub Registrar office, Yelamanchili with marriage Registration No.148 of and thereby sought for compounding of the noncompoundable offence.

A perusal of the report in registering the crime shows there was a love affair continuing between them and all of a sudden he walked out from the love affair which made her to give the report to police saying she was deceived with a promise to marry and having sexual life. Since the parties through elders married together and they both present with elders and stated that they are happily living together though there are little differences and bickering between them resulting in reporting the matter to the police.

By considering these facts, the parties are permitted to compound the non-compoundable offence(376IPC).

Having regard to the above, the Criminal Petition is allowed by quashing the proceedings in Cr.No.84 of 2017 on the file of the Rambilli Police Station, Visakhapatnam District. It is made clear that in the event of any problems to the defacto-complainant, it is not a bar for giving a fresh police report.
