This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.1 & A.2, for grant of anticipatory bail in Crime No.124 of 2011 of Malkipuram Police Station, East Godavari District, registered for the offences punishable under Sections 406, 420, 447, 379 read with 34 and Section 506-II of I.P.C.

Heard the learned counsel for the petitioners/ A.1 & A.2, the learned Additional Public Prosecutor representing the respondentState and perused the record. 3 .

The subject Calendar Case is of the year 2012. There is record to show that the petitioners/ A.1 & A.2 deliberately did not attend before the trial Court and caused delay in conclusion of trial against them. There is justification on the part of the trial Court in issuing Non-bailable Warrants against the petitioners/ A.1 & A.2. There are no circumstances to consider this application under Section 438 of Cr.P.C.

Hence, the Criminal Petition is dismissed.
