The petition coming on for hearing, upon perusing the Petition and the memorandam of grounds filed in support thereof and upon hearing the arguments of SRI.VIKAS JOSHI Advocate for the Petitioner and of the Additional Public Prosecutor (AP) for Respondent, the Court made the following.
ORDER:
This petition is filed under Section 439 Cr.P.C. to grant bail to the petitioner-A2 for the offences alleged under Sections 3 and 4 of Gaming Act and 20 (b) (ii) (c) r/w 8 (c) of N.D.P.S. Act.

Heard learned counsel for the petitioner-A2, learned Additional Public Prosecutor representing the State and perused the record.

The petitioner-A2 was remanded to judicial custody on 03.08.2017. The allegation against the petitioner is that he was indulging in cricket betting and also selling ganja to the customers. Cell phones were seized from the possession of the petitioner-A2 and 10.5 Kgs of ganja was seized from the car belonging to the petitioner-A2.

It is brought to the notice of this Court that A7 and A8 were granted bail by this Court, vide order, dated 21.11.2017 in Crl.P.No.10827 of 2017.

Having regard to the nature of allegations and quantity of ganja alleged to have been seized from the possession of the petitioner-A2, the petitioner-A2 can be granted bail.

In the result, the Criminal Petition is allowed and the petitioner-A2 is ordered to be released on bail on his executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to the satisfaction of V Additional Judl. Magistrate of I Class, Nellore, SPSR Nellore District. On release, the petitionerA2 shall not leave India without permission of the trial Court.
