HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 1 4 0 7 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Inspector of Police & SHO, MR Palli Police Station, UDP Tirupati, dated 19.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the petitioner has filed a private complaint before the Hon'ble III-AJFCM Court, Tirupati, which was forwarded to the 3rd respondent for investigation. Thereon, basing on the same, a case in Cr.No.249/ 2016, dated 05.12.2016, under Sections 464, 447, 506, 352 r/ w 156(3) Cr.P.C. was registered on the file of the 3rd respondent Police Station against one K.Subbarayudu & 3 others, wherein investigation was taken up by the Sub-Inspector of Police, MR Palli Police Station, Urban Police District, Tirupati. It is submitted that during the course of investigation, the Investigating Officer has examined

(6) witnesses and recorded their statements. After completion of investigation, the above case was referred as 'false', as per the orders of the SubDivisional Police Officer, West Sub-Division, Tirupati, vide C.No.64/ Refer/ SDPO(W)-TPT(U)/ 16, dated 30.04.2017. Thereafter, the Investigating Officer has tried to serve complainant/ s notice to the petitioner on several occasions, but the petitioner refused to receive the same. Ultimately, the complainant's notice was sent to the petitioner on 16.11.2018 and filed final report in Cr.No.294/ 2016

before the Hon'ble III-AJFCM Court, Tirupati, on 11.05.2017."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Inspector of Police & SHO, MR Palli Police Station, UDP Tirupati, dated 19.11.2018, leaving it open for the petitioner herein to avail the remedies open to him in accordance with law.
