HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21530 OF 2016 ORDER:

The case of the petitioner firm is that it has purchased different extents of land in Survey Nos.6P, 7P, 15/15, 36P, 39/1 & 1P, 60/1P, 64/4P, 64/4, 68/1P situated at Buduruwada Village of Parvathipuram Mandal, Vizianagarm District by way of registered sale deeds and the names of the petitioner's vendors also reflected in the revenue records as Pattedars and the 2nd and 3rd respondents after verifying the petitioner's vendors registered documents have followed the procedure under the Act and issued pattedar pass books and title deeds to the individual land holders and after verifying all the link documents and title deeds and pattedar pass books the petitioner firm has paid substantial amounts to their vendors and thereafter the petitioner's vendors have executed registered sale deeds in favour of the petitioner firm.

Thereafter, petitioner firm made an application in form 6A under Rule 18 of the Rules and Sec.4(1) of the Right in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') for mutation of his name in revenue records and for issuance of Pattedar Pass Books and Title Deeds. But, the 3rd respondent asked the petitioner to obtain 'No objection Certificate'. Aggrieved by the same, present writ petition is filed.

Heard both sides.

It is to be seen that petitioner claims to have purchased the subject lands by way of registered sale deeds and regarding acquisition of rights, he intimated the same under Section 4(1) of the Act to the 3rd respondent. But, it is not known under which

provision of law the 3rd respondent directed the petitioner to obtain No Object Certificate, once the subject lands are purchased through registered sale deeds and names of the petitioner's vendors were reflected in the revenue records. In view of the same, the proceedings of the 3rd respondent dated 15.11.2014 is set aside and the 3rd respondent is directed to consider and pass orders on the application of the petitioner for mutation of its name and issuance of pattedar pass books and title deeds, after issuing notice to the petitioner as well as to the affected parties, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 08.07.2016 tk
