THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10934 OF 2017 ORDER:

This criminal petition is filed under Section 482 Cr.P.C to quash the proceedings in C.C.No.67 of 2013 on the file of Judicial First Class Magistrate at Sathyavedu, Chittoor District. Sri Gandham S.R. Prasad, learned counsel for the petitioner, requested this Court to recall the NBW issued against the petitioner, without touching the merits of the case. But, such request of the learned counsel for the petitioner cannot be acceded to by this Court. However, without touching the merits of the case, I deem it appropriate to direct the Court below to pass appropriate order on the petition filed by the petitioner, if any, to recall NBW under Section 70(2) Cr.P.C, after serving notice on the respondent(s) on the same day, on their appearance. In the result, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
