This Criminal Petition, under Sections 437 and 439 of Cr.P.C., is filed by the petitioner/accused No.1, seeking regular bail in Crime No.378 of 2017, on the file of Patamata Police Station, Vijayawada, Krishna District, registered for the offence punishable under Section 8 (c) r/w 20 (b) (ii) (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondentState and perused the record. The learned Counsel for the petitioner/accused No.1 would submit that the petitioner is an innocent person and that there is nothing to believe that 75 bags of Ganja was seized from his possession. The learned Counsel, ultimately, prayed to allow this Application.
Dr.SA, J Crl.P.No.10681 of 2017 Dt: 13-11-2017 The learned Public Prosecutor opposed for grant of bail to the petitioner.
A perusal of the material available on record would show that 75 bags of Ganja, which is a commercial quantity, was seized from the possession of accused Nos.1 and 2 on 08-06-2017 under a cover of panchanama. In view of the same, it is not appropriate to grant bail to the petitioner. Hence, the Criminal Petition is dismissed.
