Heard counsel for the petitioner and Sri R.Vinod Reddy, Standing Counsel for respondents 1 to 4.

Petitioner is a tenant in the premises belonging to the 5th respondent.

The said premises was provided with an electricity service connection in the name of 5th respondent. Due to disputes between the petitioner and 5th respondent, it appears that the electricity service connection was disconnected by respondents 1 to 4, at the instance of the 5th respondent. Petitioner seeks reconnection of the same.

The Standing Counsel for respondents 1 to 4 contended that since the service connection was issued in the name of 5th respondent and the 5th respondent wished that the said connection may be withdrawn, the respondents 1 to 4 have no choice but to do so.

4. Having regard to the said submission, this Court is not inclined to direct respondents 1 to 4 to restore service connection which is in the name of 5th respondent.

However, it is not disputed by the Standing Counsel for respondents 1 to 4 that as per the Regulation in force, even the petitioner can apply for electricity service connection being the occupant of the subject premises, subject to certain conditions stipulated in the regulations.

6. Therefore, the Writ Petition is disposed of directing the petitioner to apply for a fresh service connection in the manner prescribed under

the Regulations to the Integrated Consumer Service Centre set up by the respondents 1 to 4, and if such an application is made, the respondents shall consider the same within ten (10) days from the date of receipt of the said application and provide electricity service connection, subject to the petitioner complying with all the terms and conditions specified under the Regulations. There shall be no order as to costs.

7. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
