THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9816 OF 2017 ORDER:

This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A7 for the offences alleged under Sections 120-B r/w 34 IPC and 8 (c) r/w 20 (b)(ii) (c) of NDPS Act.

Heard learned counsel for the petitioner, learned Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner-A7 would submit that the allegation against the petitioner, Circle Inspector, Maredumilli circle, East Godavari District, under suspension is that he has collected Rs.1,50,000/- to facilitate transportation of ganja. He has also introduced one of the constables by name Satyanarayana, who is also accused in this case, to pass on the information, who in turn also collected Rs.20,000/-. The allegations are false. There is no material to hold the same. The petitioner registered several cases of ganja against the culprits and ultimately prayed to grant bail to the petitioner under Section 438 Cr.P.C.

Learned Public Prosecutor opposed grant of bail to the petitioner and also submitted that earlier W.P.No.42236 of 2016 was filed before this Court to quash the proceedings and the same was dismissed by order, dated 22.06.2017. There are no circumstances to grant bail to the petitioner. The petitioner is required for investigation purpose and ultimately prayed to dismiss the petition.

There is material to show that the petitioner took money of Rs.1,50,000/- to facilitate transportation of ganja. The petitioner also introduced one of the constables by name Satyanarayana, who is also accused in this case and charge sheet is also filed, wherein the Investigating Officer mentioned that A7 is absconding. Therefore, charge sheet was filed against A1 to A6. Additional charge sheet will be filed after apprehending the absconding accused. In view of specific allegations against the petitioner-A7, he is not entitled for bail under Section 438 Cr.P.C.
