HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.10117 of 2016 ORDER:

This Writ Petition under Article 226 of the Constitution of India is filed for the following relief.

"...pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent University in not releasing the maternity benefit with consolidated pay of 180 days as per G.O.Ms.No.152, dated 4.5.2010 as arbitrary, discriminatory and violative of Articles 14,15(3), 16 and 42 of Constitution of India and consequently direct the respondents to forthwith grant maternity benefit with full consolidated pay for 180 days as per G.O.Ms.No.152 dated 4.5.2010 issued by the Government of Andhra Pradesh in the interest of justice..."

Heard Sri G.Ram Gopal, learned Counsel for the petitioner, Sri Battula Raj Kiran, learned Standing Counsel for Respondents 1 to 3 and learned Government Pleader for Education appearing on behalf of the fourth respondent. When the matter is called, it is submitted by the learned Counsel for the petitioner that the petitioner herein for redressal of her grievance submitted a representation on 26.02.2016 to the second respondent and no further orders have been passed on the said representation. It is further represented that the respondents may be directed to dispose of the said representation by fixing some time frame. The said request of the learned Counsel for the petitioner is opposed by the other side and they submitted that the said representation of the petitioner would be considered and disposed of in accordance with law.

In view of the same, this Writ Petition is disposed of without expressing any opinion on the entitlement of the petitioner, directing the second respondent to consider the representation of the petitioner dated 26.02.2016 and pass appropriate orders, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
