Panga Nithya Puja Reddy v. The State Of A.P.,
THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10972 OF 2017 ORDER:
Heard learned counsel for the petitioners/A.1 and A3 and learned Additional Public Prosecutor for the respondent State, and perused the record.
This petition is filed under Section 438 Cr.P.C. for grant of bail to the petitioners/A.1 and A.3 in Crime No.167 of 2017 of Badvel Urban Police Station, Y.S.R. Kadapa District, for the offences punishable under Sections 324, 306 and 426 IPC read with Section 34 IPC.
Learned counsel for the petitioners would submit that now the charge sheet is filed in this case. The dispute between the parties is civil in nature and prayed to allow the petition. While dealing with the matter in Crl.P.No.7491 of 2017, this Court dismissed the bail application of the petitioners on 12.09.2017 assigning number of reasons. Filing charge sheet is not a ground to allow the petition. Further, there are specific allegations against the petitioners to constitute the offences under Sections 324, 306 and 426 IPC read with Section 34 IPC. It cannot be said that the dispute is civil in nature.
Therefore, the Criminal Petition is dismissed. ____________________________ Dr. SHAMEEM AKTHER, J 20th NOVEMBER, 2017.
