This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, seeking grant of bail to the petitioner, who is A1, in Cr.No.77 of 2017 on the file of the Station House Officer, Mudivedu Police Station, Chittoor District. The offences alleged are under Sections 195-A, 452, 323 and 506 read with Section 34 of the Indian Penal Code.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

The counsel for the petitioner though fairly submits that the earlier bail petition was dismissed, he argues, that only in order to invoke the provisions under the PD Act, the cases are filed. 4.

However, the order passed in CRLP.No.9519 of 2018 dated 18.09.2018, dismissing the bail petition, shows that elaborate discussion was taken up by the Court and after considering the facts of the case, the Court opined that the petitioner was not entitled for grant of bail.

Hence, in view of the above, this Court opines that this is not a fit case for grant of bail to the petitioner. Hence, the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. __________ T. RAJANI, J November 26, 2018 DSK
