Mr. Suresh Reddy, v. The State Of Telangana,
THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40067 of 2016
ORDER
This writ petition is filed seeking to declare the action of 3rd respondent in not registering the complaint dated 30.07.2016 filed by petitioner against respondents 4 and 5 for criminal breach of trust, criminal intimidation, theft, misappropriation of properties, as illegal and arbitrary. 2.
The main grievance of petitioner is that though he lodged a complaint on 30.07.2016 against respondents 4 and 5 for stealing of movable and fixed articles belonging to the property of petitioner without his consent and contrary to the understanding, the Station House Officer, Jubilee Hills Police Station, Hyderabad, 3rd respondent herein, is not registering the crime till today.
3.
Considering the facts and circumstances of the case, the 3rd respondent is directed to register the crime against respondents 4 and 5 if the complaint lodged by petitioner dated 30.07.2016 discloses any cognizable offence, investigate into the same and file a final report, if any, in accordance with law. If the petitioner is aggrieved by the action of the 3rd respondent, he is at liberty to approach the superior officer of 3rd respondent and also to approach the concerned Court by invoking the provision under Section 200 Cr.P.C.
4.
Accordingly, the Writ Petition is disposed of. No costs. Pending miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 19th December, 2016 sj
