HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.11019 OF 2002 ORDER:

This writ petition is filed challenging the award in I.D.No.299 of 1999 dated 8.1.2002, wherein the 2nd respondent-Labour Court set aside the order of termination and directed the petitioners herein to reinstate the 1st respondent-workman into service without back wages and to defer five annual increments with cumulative effect. 2.

It has been reported by the learned Standing Counsel for the petitioners that the 1st respondent-workman was reinstated into service and in view of the same, the cause in the present writ petition does not survive. 3.

Even on merits, when once the Labour Court exercised its powers under Section 11-A of the Industrial Disputes Act, until and unless some irregularity or illegality has been pointed out in the order passed by the Labour Court, the Court cannot interfere with the award passed by the Labour Court. No illegality or irregularity has been pointed out by the learned Standing Counsel for the

petitioners in the award impugned and therefore, this Court is not inclined to interfere with the award impugned. 4.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
