HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17877 OF 2016 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in passing Refusal Order No.473 of 2015 dated 26.10.2015 pertaining to the land purchased by the petitioner in Sy.No.563/3 admeasuring Ac.0.44 1⁄2 cents situated at Kuragallu Village, Mangalagiri Mandal Guntur District, as illegal and arbitrary. When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the present writ petition is covered by the judgment in W.P.No.9311 of 2016 dated 22.03.2016 and the same is not disputed by the learned Assistant Government Pleader for Revenue.

For the reasons alike, the impugned order dated 26.10.2015 in Refusal Order No.473 of 2015 passed by the 3rd respondent is set aside and the matter is remitted back to the 3rd respondent to consider the matter in the light of the judgment of this Court report in District Collector, Anantapur District vs. M.Sadasiva Reddy[1] and if he is not inclined to register the document presented by the petitioner, he shall pass a fresh order under Section 71 of the Registration Act, 1908 within a period of four weeks from the date of receipt of a copy of this order and communicate his decision thereon to the petitioner. Accordingly, the writ petition is disposed of in terms of the order dated 22.03.2016 in W.P.No.9311 of 2016. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.

A copy of the order in W.P.No.9311 of 2016 dated 22.03.2016 is to be annexed to this order.
