Sundaram John Raveen Milton, S/o S.Titus Paul ..... Petitioner And:

M/s Margadarsi Chit Fund Pvt Ltd., Anantapuram, reptd by its Manager/Foreman and another.

.....Respondents Counsel for the petitioner: Mr. R.Gopi Mohan Counsel for the respondent: Mr. P.Durga Prasad The Court made the following:

CVNR, J & TRJ Dated:09.02.2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Judgment-debtor No.4 who stood as surety to respondent No.2-the principal borrower filed this Civil Revision Petition feeling aggrieved by order, dated 28.9.2016, in E.P.No.507 of 2015 in D.R.A.No.143 of 2013 on the file of the learned Principal Senior Civil Judge, Anantapuram, whereunder she has made the attachment order, dated 15.02.2016, absolute. The only ground raised by Mr. R.Gopi Mohan, learned counsel for the petitioner, at the hearing, is that deduction of a sum of Rs.8,904/- from his client's gross salary of Rs.27,712/- is causing severe hardship to him.

After hearing Mr. P.Durga Prasad, learned counsel for respondent No.1, and having regard to the facts and circumstances of the case, the attachment of salary of the petitioner per month is reduced to Rs.6,500/- and it is made clear that this reduction is only prospective. Except the above modification, order, dated 28.9.2016, in E.P.No.507 of 2015 in D.R.A.No.143 of 2013 on the file of the learned Principal Senior Civil Judge, Anantapuram is confirmed in all other respects and the Civil Revision Petition is partly allowed.

CVNR, J & TRJ Dated:09.02.2017 As a sequel to disposal of the Civil Revision Petition, CRPMP.No.8415 of 2016 filed by the petitioner for interim relief is disposed of as infructuous.
