THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11354 of 2017 ORDER:

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/accused for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Learned Additional Public Prosecutor on instructions would submit that no crime is registered against the petitioner in Palakonda Police Station of Srikakulam District. It is brought to the notice of this Court that the petitioner has filed O.P. for restitution of conjugal rights and the same is pending consideration. He apprehended arrest at the hands of the police. So, he filed this petition. It is made very clear that since no crime is registered against the petitioner, he is not entitled for the relief under Section 438 Cr.P.C. Further, the police are directed not to call the petitioner to the Police Station or harass in any manner whatsoever without there being registration of any crime.

With the above direction, the Criminal Petition is disposed of.
