THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37060 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in opening and continuing the rowdy sheet against the petitioner as illegal and violation of the rights guaranteed under Articles 14, 19 and 21 of the Constitution of India and consequently, to set aside the same. Heard and perused the material.
Learned counsel for the petitioner submits that third respondent herein opened a rowdy sheet against the petitioner herein on the basis of the crime committed by the petitioner in 2010. He further submits that thereafter the petitioner is acquitted by the competent Court and that the petitioner has not involved in any other crime after 2010 and as such, continuation of the rowdy sheet against the petitioner is illegal and arbitrary. Hence, he prays this Court to close the rowdy sheet against the petitioner.
Considering the facts and circumstances of the case, the third respondent is directed to verify involvement of the petitioner in any other crime after 2010 and if it is found that the petitioner has not committed any offence after 2010, the third respondent is directed to close the rowdy sheet opened against the petitioner and pass appropriate orders to that effect.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
