THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41522 of 2018 ORDER:

In the light of the order proposed to be passed by this Court without going into the merits of the matter, there is no necessity to put the unofficial respondents on notice or afford them an opportunity of hearing. The grievance of the petitioner is that the Collector, Karimnagar District, the revisionary authority, is not disposing of Revision Petition No.3131 of 2017 filed by him.

Learned Assistant Government Pleader for Revenue, State of Telangana, informs this Court, on instructions, that the revision petition has not been disposed of as on date.

Perusal of the record reflects that the revision was taken on file by the revisionary authority as long back as on 01.12.2017. It is not open to a statutory quasi-judicial authority to entertain a revision petition and thereafter sleep over the matter. The valuable property rights of the parties would stand negated by such inaction.

The writ petition is accordingly disposed of directing the Collector, Karimnagar District, to consider Revision Petition No.3131 of 2017 filed by the petitioner on its own merits and in accordance with law and pass appropriate reasoned order thereon. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
