HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21690 OF 2016 ORDER:

The order under challenge is suspension pending enquiry dated 20.05.2016. The petitioner is authorized dealer of fair price Shop No.9 of Morjampadu Village, Machavaram Mandal, Guntur District since 1994. While so, based on the report submitted by the 3rd respondent - Tahsildar, Morjampadu Village, Machavaram Mandal, the 2nd respondent issued a show cause notice on 18.02.2016 levelling certain allegations that she is habitually diverting stocks to black market, to which the petitioner submitted her explanation on 25.02.2016. Dissatisfied with the same, the 2nd respondent by order, dated 20.05.2016, suspended the authorization of the petitioner. Aggrieved by the same, the petitioner filed the present writ petition.

Learned counsel for the petitioner submitted that there is no allegation of variation of stocks and the stocks are beyond permissible limits. Hence, the impugned order may be suspended.

Taking into consideration the fact that there is no allegation of variation of stocks and the stocks are beyond permissible limits, there shall be a direction to the respondents to complete the enquiry and pass final orders, after considering the explanation submitted by the petitioner within a period of four weeks from the date of receipt of a copy of this order by duly observing the principles of natural justice and affording an opportunity of being heard to the petitioner. With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any pending in the writ petition, shall stand closed. ______________________________ CHALLA KODANDA RAM, J.
