HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23957 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the second respondent in not setting aside the proceedings in Rc.No.B1/3936/2015, dated 17.10.2015 passed by the third respondent and remanding the matter to the third respondent as was done in identical case Rc.No.B2/SRA/62/2015, dated 06.04.2016.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

A perusal of the record reveals that the competent authority initiated disciplinary proceedings against the petitioner alleging that the petitioner has violated the provisions of Section 3 of the Essential Commodities Act and the Andhra Pradesh Scheduled Commodities Dealers (Licensing, Storage and Regulation) Order, 2008. After conducting enquiry, the third respondent arrived at a conclusion that the petitioner herein violated the control orders and consequently cancelled the authorization issued to the petitioner for shop No.0681037 at Chilakalapudi, Machilipatnam. Feeling aggrieved by the orders of the third respondent, the petitioner herein preferred an appeal before the second respondent - Joint Collector, Krishna District, Machilipatnam.

Learned counsel for the petitioner submitted that the second respondent may be directed to dispose of the appeal filed by the petitioner within a reasonable time.

Learned Assistant Government Pleader also submitted that the appeal filed by the petitioner will be disposed of within a reasonable time.

Having regard to the submissions made by both counsels, the second respondent is hereby directed to dispose of the appeal filed by the petitioner as early as possible, preferably, within a period of two months from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
